Applies to: USA Mobile services and all services operated on the USA Mobile platform, including partner-branded or powered-by USA Mobile offerings
- Agreement to Terms
These Terms & Conditions (“Terms”) govern your use of wireless services, websites, applications, portals, and related services provided by USA Mobile, LLC (“USA Mobile,” “we,” “our,” or “us”).
These Terms apply to services offered under the USA Mobile name and to services offered under partner-branded or powered-by USA Mobile programs.
By activating, using, or purchasing service, you agree to these Terms.
If you do not agree, do not activate or use the service.
- Service Provider
USA Mobile, LLC is the wireless service provider and MVNO operator for services delivered on the USA Mobile platform, unless otherwise stated.
Services may be marketed, distributed, or promoted under partner brands, licensed programs, or bundled offerings, but the wireless service is provided by USA Mobile, LLC. USA Mobile maintains the subscriber account, billing relationship, and service activation for all services delivered on the USA Mobile platform unless expressly stated otherwise.
Wireless service is provided using third-party carrier networks.
USA Mobile may use authorized carriers, subscriber-management platforms, billing systems, cloud providers, customer-support providers, security providers, and other contracted vendors to operate the service.
These providers act on behalf of USA Mobile and may access information only as necessary to perform their assigned functions.
USA Mobile is not responsible for acts, omissions, outages, or failures of third-party carriers, vendors, or service providers, except as required by applicable law.
Coverage, speeds, and service quality depend on network availability.
Service may be provided using 5G, 4G LTE, or other network technologies where available.
Access to 5G or higher-speed data depends on device compatibility, plan type, network availability, and carrier limitations.
Not all devices or plans support all network technologies, and speeds may vary.
Service is not guaranteed in all areas.
- Prepaid Service
All plans are prepaid unless otherwise stated.
You must pay for service in advance.
Service will not continue if payment is not received.
USA Mobile does not require credit checks for prepaid service.
USA Mobile does not collect Social Security numbers.
- Plan Details and Consumer Broadband Labels
Plan details, pricing, speeds, and data allowances are provided in the applicable Consumer Broadband Label and plan description.
The Consumer Broadband Label controls if there is any difference between the label and marketing materials.
Speeds and performance may vary based on:
- Network conditions
- Device capability
- Location
- Congestion
- Prioritization policies
Unlimited plans may be subject to network management.
- Network Use and Limitations
Service is provided on third-party wireless networks and is subject to the policies, limitations, and technical restrictions of those networks.
USA Mobile does not guarantee:
- Coverage
- Speed
- Availability
- Call quality
- Data throughput
Network management may include:
- Prioritization
- Throttling
- Blocking
- Temporary suspension
These actions may occur to:
- Protect the network
- Prevent fraud
- Comply with law
- Follow carrier rules
- Acceptable Use
You agree not to use the service for:
- Fraud
- Spam
- Robocalling
- Auto-dialing
- SIM farming
- Resale of service
- Commercial call routing
- Illegal activity
- Harassment
- Network interference
USA Mobile may suspend or terminate service for violation of these rules.
Carrier rules may also require suspension.
- Account Responsibility
You are responsible for:
- All use of your account
- All charges on your account
- Device security
- Password protection
If your device is lost or stolen, contact support immediately.
USA Mobile is not responsible for unauthorized use before notice is received.
- Third-Party Services and Bundles
Some plans may include optional features, bundles, or add-on services provided by third parties.
These services may include:
- Protection plans
- Monitoring tools
- Applications
- Accessories
- Financing
- Partner offers
Third-party services are governed by their own terms.
USA Mobile is not responsible for third-party services.
Participation in optional services may require sharing limited information necessary to provide the service.
You may opt out of optional services when available.
Some services may be offered in connection with licensed brands, partner programs, or promotional bundles.
Branding, themes, or bundled content do not change the identity of the wireless service provider.
USA Mobile remains the service provider unless expressly stated otherwise.
- International Calling
International calling may be available.
International services may be provided through third-party international carriers.
Separate International Long Distance terms may apply.
Rates and availability may change at any time.
International calls are not included unless stated.
- Suspension or Termination
USA Mobile may suspend or terminate service for:
- Non-payment
- Fraud
- Abuse
- Excessive use
- Illegal activity
- Carrier request
- Regulatory request
- Network protection
- Violation of these Terms
Service may also be suspended for security reasons.
No refunds are required for suspended accounts unless required by law.
- Emergency Services (E911)
Emergency calling may not work in all situations.
Location information may not always be accurate.
Emergency service availability depends on:
- Device
- Network
- Coverage
- Power
- Wi-Fi availability
Do not rely on wireless service as your only means of emergency communication.
Additional E911 disclosures may apply.
- Regulatory and Carrier Compliance
USA Mobile services are subject to applicable federal, state, and local telecommunications laws, FCC regulations, carrier requirements, and industry standards.
Service may be modified, suspended, or restricted as necessary to comply with regulatory obligations, carrier rules, fraud-prevention requirements, or network-security requirements.
- Privacy
Your use of the service is subject to the USA Mobile Privacy Policy.
Children’s use of the service is subject to the Children’s Privacy & COPPA Policy.
These policies are available on the applicable website or portal.
- Limitation of Liability
To the maximum extent allowed by law:
USA Mobile is not liable for:
- Service interruptions
- Network failures
- Lost data
- Third-party services
- Indirect damages
- Consequential damages
- Lost profits
To the maximum extent allowed by law, USA Mobile’s total liability will not exceed the amount paid for service during the previous billing period, except where a different limitation is required by law.
Some states may not allow certain limitations.
- Arbitration and Dispute Resolution
Any dispute will be resolved by binding arbitration.
You agree not to participate in class actions.
Arbitration will be conducted individually.
This section does not limit rights where prohibited by law.
- Governing Law
These Terms are governed by the laws of the State of Nevada, without regard to conflict of law rules.
Any legal action not subject to arbitration must be filed in Nevada.
- Changes to Terms
USA Mobile may update these Terms at any time.
Updated Terms will be posted on the website or portal.
Continued use of service means you accept the updated Terms.
